These terms govern your use of hiiAmber.com and any order you place on it. The site is operated by Amber Technologies, Inc. By using the site or placing an order you agree to them. If you do not, please do not use the site.
Who we are
Amber Technologies, Inc. designs and sells Amber, a standalone AI home computer. Throughout these terms, "we", "us" and "our" mean Amber Technologies, Inc., and "you" means the person using the site or placing the order.
Using the site
You may browse, order and read anything published here. You may not use the site to break the law, to interfere with how it works, to scrape it at a scale that degrades it for other people, or to attempt access to any part of it that is not public. We may suspend access where we reasonably believe one of those is happening.
Eligibility
You must be old enough to enter a contract where you live, and the payment method you use must be yours to use. Orders may be limited to one household or one address where we need to keep the First Edition run fair.
Products and pre-orders
Amber is currently sold by pre-order and is in development. Images, descriptions and specifications on this site are our best current description of the product and are confirmed before the First Edition ships. The full pre-order agreement, including the ship window and cancellation, is set out on the pre-order terms page and forms part of these terms.
Prices and payment
Prices are shown in the currency displayed at checkout and may change at any time before you order. The price you paid is the price of your order, and we do not reprice an order after it is placed. Taxes are calculated at checkout. We may refuse or cancel an order where a price or description was obviously wrong, where payment fails, or where we suspect fraud, and in each case we refund anything already taken.
Discount codes and set pricing
Discount codes apply one at a time at checkout, are not exchangeable for cash and may be withdrawn or changed at any time before you use them. Set pricing for multiple units is applied automatically in the cart.
Shipping, refunds, returns and warranty
Delivery is covered by our shipping page, money by our refund policy, sending a unit back by our returns page, and faults by our warranty. Each of those pages forms part of these terms.
Accuracy of the site
We work hard to keep the site accurate, but it may contain errors and we may correct them without notice. Where an error affects an order you have already placed, we contact you and you can cancel for a full refund.
Intellectual property
The Amber name and mark, the site design, the photography, the text and the product design are ours or are used with permission. You may share and link to our pages. You may not copy, resell or use them commercially without our written permission. Other company and product names on this site belong to their owners and are used only to describe or compare.
Content you send us
If you send us feedback, questions or ideas, we may use them to improve the product without owing you anything for them. Do not send us anything you consider confidential.
Third-party services and links
The store runs on Shopify, payments are handled by our payment processor, and delivery is handled by carriers. Their own terms apply to the part they perform. Links from this site to other sites are for convenience, and we are not responsible for what those sites do.
Disclaimers
The site is provided as it is. We do not promise the site will be uninterrupted or error free. Nothing in this section excludes any warranty or right the law does not allow us to exclude, including the product warranty we give you above.
Limitation of liability
To the extent the law allows, our total liability arising from your order is limited to the amount you paid for it, and we are not liable for indirect or consequential loss. Nothing here limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be limited.
Indemnity
You agree to cover us against claims arising from your misuse of the site or your breach of these terms.
Governing law
These terms are governed by the laws of the state in which Amber Technologies, Inc. is incorporated, and any dispute is heard in the courts of that state. If you buy as a consumer somewhere else, you keep the rights and the local courts your own law gives you.
Changes
We may update these terms. The version published here when you place an order is the version that governs it, so it is worth reading them at the time rather than relying on a copy from before.
